The civil window would ensure that any offending individuals or organizations would be held accountable. Children would be safer with the passage of this act because the public would hear evidence of how organizations failed to protect children from sexual abusers in the past. The threat of civil damages would motivate organizations to prioritize protecting children from abusers rather than keeping ugly secrets to protect their reputations.
The merit of the accusations will be determined by the time-honored American judicial system and established rules of evidence. False accusations will be limited by a provision in the bill which would allow the falsely accused to sue for attorneys’ fees in the unlikely case of capricious or malicious suits.
The Child Victim's Act would give the silenced a way to use their voices. As a law, the bill would give victims in the state of Delaware the chance to tell the truth and be heard in a court of law. Simply stated, the Child Victims’ Act protects children.
