Delaware Senate Bill 29: The Child Victim's Voice
This bill eliminates the civil statute of limitations for sexual abuse of children. It would give child victims of unspeakable sexual trauma the chance to speak up in a way that they were previously unable to. Current Delaware law only gives victims of child sexual abuse two years from the date of abuse to use the courts for a civil remedy. Victims would be able to sue both the perpetrators and organizations that are found negligent in their responsibility to protect children from sexual abuse. Perpetrators and any organization that puts children at risk will be held responsible for civil damages.

The two-year civil window protects children. Many sexual predators have never faced consequences for the crimes they committed because the current Delaware law shields them from criminal prosecution and civil action. Children are exposed to dangerous child predators at this moment and ongoing. The civil window will ensure that any offending individuals or organizations will be held accountable. Children will be safer with the passage of this act because the public will hear evidence of how institutions failed to protect children from sexual abusers. The threat of civil damages will motivate institutions to prioritize protecting children from pedophiles rather than keeping ugly secrets to protect their reputations.

The merit of the accusations will be determined by the time-honored American judicial system and established rules of evidence. False accusations will be limited by a provision in the bill which allows the falsely accused to sue for attorneys' fees in the unlikely case of capricious or malicious suits.

The Child Victim's Voice offers the silenced a way to use their voices. As a law, the bill will give child victims in the state of Delaware the chance to tell the truth and be heard in a court of law. Simply stated, the Child Victim's Voice protects children.
